IES Training will look at the process, try to simplify the law, and explain what is involved.
- You should book yourself on a training course like one run by IES Training across the country and obtain a Level 2 or Level 3 Award in Taking Control of Goods; this shows the Judge you have the basic knowledge of the law to be considered as a Certificated Enforcement Agent.
- Gather all your documentation, including all of the prescribed forms required for Enforcement and carry out a CCJ check at the Registry Trust Online; two passport photos, Two references, and your completed EAC1 application form and send them to the County Court Business Centre in Northampton.
- Await for a court date get your DBS to check together with your bond, and await your court date.
What is a fit and proper person?
Unfortunately, there is no exact definition within the act, but this is interpreted differently by each Judge who hears your certificate application or renewal.
The English Dictionary defines Fit and Proper Person as “Morally Suitable”, so looking at your current position in life, the judge will determine if you have any County Court Judgements (CCJ) or a criminal record, do they affect your moral judgement or in the Judge’s belief your ability to deal with the job.

3. A certificate may be issued under section 64 of the Act only—
(a) on application by the person to whom the certificate is to be issued; and
(b) if the judge is satisfied that—
(i) the applicant is a fit and proper person to hold a certificate;
(ii) the applicant possesses sufficient knowledge of the law and procedure relating to powers of enforcement by taking control of goods and of commercial rent arrears recovery to be competent to exercise those powers;
(iii) the forms that the applicant intends to use when exercising powers of taking
control of goods or commercial rent arrears recovery conforms to the design and
layout prescribed in the Schedule to these Regulations;
(iv) the applicant has lodged the security required by regulation 6(1), or such security is already subsisting; and
(v) the applicant does not carry on and is not and will not be employed in a business which includes buying debts.
